1. Introduction

Welcome to OakGrovePoint ("Company," "we," "us," or "our"). These Terms & Conditions ("Agreement") govern your use of our yacht charter services and website at oakgrovepoint.sbs (termed the "Service") managed by OakGrovePoint.

By reserving a yacht or utilizing our Service, you consent to be adherent to this Agreement. Should you disagree with any portion of these terms, you are not permitted to use the Service.

2. Service Overview

OakGrovePoint offers luxury yacht charter services that include, but are not limited to:

• Single-day yacht rentals
• Evening cruises
• Business retreats
• Exclusive celebrations
• Extended charters

All offerings are dependent on vessel availability and prevailing weather conditions. We hold the authority to alter or halt services without prior notice.

3. Booking and Reservations

3.1 Reservation Process

For a charter reservation, you are required to:

• Be at least 18 years of age
• Supply valid and comprehensive details
• Submit the necessary deposit as outlined in your reservation confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

Confirmation of your reservation is only provided upon our acceptance of payment and issuance of written confirmation. We retain the right to deny service to any individual as per our discretion.

3.3 Charter Availability

Charters are offered subject to the availability of the vessels and suitable meteorological conditions. We will exert reasonable endeavors to fulfill your requested dates and times.

4. Payment Terms

4.1 Fees

All fees are presented in € and incorporate all applicable taxes, unless explicitly stated otherwise. Prices are liable to alteration without notice.

4.2 Payment Schedule

• Initial Payment: A sum equivalent to 50% of the entire charter cost is due upon reservation
• Final Payment: The outstanding balance is required 48 hours before the charter's departure
• Incidental Charges (if they occur): Payable after the charter concludes

4.3 Forms of Payment

We accept major credit cards, wire transactions, and bank-certified cheques. Our payment processing is facilitated through encrypted protocols for security.

5. Cancellation and Refunds

5.1 Client Cancellation

• Cancellation over 72 hours before departure: Complete reimbursement minus transaction fees
• Between 24 to 72 hours before departure: Half of the sum refunded
• Less than 24 hours prior to departure: No compensation

5.2 Weather-Related Cancellation

If sailing conditions are deemed hazardous by our captain, we will propose an alternative date without extra fees, or if rescheduling is not viable, a full repayment will be made.

5.3 Mechanical Difficulties

Should mechanical issues arise with your allocated yacht, our efforts will pivot to providing a comparable substitute vessel. If this proves infeasible, you will receive a full refund.

6. Safety and Behaviour

6.1 Safety Protocols

All guests are expected to:

• Obey all directions from the crew
• Utilize safety equipment when deemed necessary
• Disclose any medical conditions potentially affecting their well-being
• Stay within designated sections of the yacht

6.2 Restricted Items

The following items are strictly prohibited on the yacht:

• Containers made of glass
• Illegal substances
• Weapons or firearms
• Non-alcoholic beverages (above moderate consumption)
• Pets (except with prior approval)

6.3 Conduct

Passengers are to maintain courteous conduct at all times. A charter may be concluded prematurely without reimbursement if a guest's behaviour is deemed a safety hazard or causes significant disruption to others.

7. Liability and Assurance

7.1 Our Responsibility

Our liability to you is limited to the charter payment amount. We are not liable for:

• Injuries sustained due to passenger carelessness
• Theft or damage to personal belongings
• Indirect or punitive damages
• Delays arising from weather or events beyond our control

7.2 Insurance

We uphold extensive insurance that covers our fleet and operations. Clients are advised to secure their own travel and personal insurance policies.

7.3 Risk Acknowledgement

Engagement in our charter services signifies your admission to the inherent risks associated with maritime activities, and you willingly assume accountability for your security and health.

8. Amendments to Itineraries

We retain the discretion to alter travel plans, paths, or schedules owing to weather circumstances, safety concerns, or operational necessities, aiming to ensure a comparable level of service.

9. Force Majeure

We withhold accountability for any postponements, annulments, or changes instigated by factors outside our control, including but not restricted to:

• Extreme weather conditions
• Catastrophes
• Regulations by authorities
• Harbor closures
• Vessel malfunctions

10. Privacy and Information Security

Your personal data will be treated in alignment with our Privacy Policy. By electing our services, you agree to the compilation and usage of your data as detailed in the Privacy Policy.

11. Ownership of Content

All materials on our website, encompassing words, visuals, emblems, and photographs, are secured by copyright and trademarks. Unauthorized reproduction, dissemination, or creation of derivative works is strictly forbidden without our express consent.

12. Applicable Legislation

These Terms are subject to the laws in force in Germany. Any disputes shall be settled in the judicial courts located in Hamburg, Germany.

13. Revisions to Terms

These Terms may be revised at our discretion at any time. Notification of changes will be displayed on our website along with the revision date. Ongoing service use after modifications indicates acceptance of the new terms.
